1. Acceptance of Terms

By accessing or using Kshema (“Service”), you agree to be bound by these Terms & Conditions.

If you do not agree, please discontinue use of the Service.

2. Description of Service

Kshema is a WhatsApp-based family coordination platform that enables:

• Check-ins
• Alert notifications
• Emergency contact notifications

Kshema is not a hospital, medical provider, emergency response service, or insurance provider.

3. No Medical or Emergency Services

Kshema:

• Does not provide medical advice
• Does not diagnose or monitor health conditions
• Does not dispatch ambulances or emergency personnel
• Does not guarantee emergency response

In case of a medical emergency, users must immediately contact local emergency services.

4. User Responsibilities

Users agree to:

• Provide accurate phone numbers
• Obtain consent from parents and emergency contacts
• Maintain confidentiality of OTPs
• Not misuse the alert system

Users are responsible for ensuring emergency contacts are aware they are being listed.

5. Subscription & Payments

Subscriptions are billed monthly, annually, or as otherwise specified.

Payments are processed via third-party payment providers.

Failure of payment may result in suspension of service.

6. Phone Number Changes

Registered phone numbers may be updated after OTP verification. We reserve the right to limit frequent changes for security purposes.

7. Service Availability

We aim to maintain high service availability but do not guarantee uninterrupted service. Service may be affected by:

• WhatsApp outages
• Telecom disruptions
• Technical maintenance
• Third-party infrastructure issues

8. Limitation of Liability

To the maximum extent permitted by law, Kshema shall not be liable for:

• Failure or delay in message delivery
• Non-response from emergency contacts
• Medical incidents
• Service interruptions caused by third-party systems

Use of the service is at your own risk.

• Service provided “as is”
• No guarantee of uninterrupted service
• Not responsible for telecom/network failures
• Maximum liability limited to subscription fee paid

9. Termination

We may suspend or terminate accounts for:

• Violation of terms
• Fraudulent activity
• Misuse of the service

Users may cancel subscriptions at any time.

10. Governing Law

These Terms are governed by the laws of India. Jurisdiction in Bengaluru city, India.

11. Force Majeure Clause

Protects you if service disruption happens due to:

• Natural disasters
• Government restrictions
• Platform bans
• WhatsApp outages
• Internet shutdowns
